Dan is the senior partner of the firm with over 36 years of experience in real estate, syndicated financing, transactions, foreclosures, developments, workouts, corporate and commercial litigation. Dan is a former partner of Fabian & Clendenin where he chaired that firm's real estate section and served on the board of directors and management committee. Real Estate:Real estate experience includes representation of both local and out of state clients in all areas of practice, including acquisitions, sales, secured financing, syndicated financing, bond financing, leases, entitlement and master planning, zoning and development, loan modifications, short sales, condominiums and title claims and issues. Dan is experienced in 1031 and 1033 exchange transactions and works with several intermediaries. Real Estate Litigation:Dan's wealth of real estate experience spans all related areas of litigation including boundary disputes, quiet title actions, complicated foreclosures, partition actions, mechanic's liens, homeowner association liens, construction defects, title disputes, easements, defense of eminent domain actions and receiverships, and proceedings on behalf of creditors to lift the automatic stay in bankruptcy actions. Business Law:Dan is experienced in advising numerous business clients regarding business formation and operation, mergers, acquisitions, sale of assets, business planning and protection of intellectual property rights Commercial Litigation:Dan is not a novice in the court room. He is experienced in commercial litigation on behalf of lenders, developers, owner associations, title companies, underwriters, insurance companies, and other and business entities. He is also experienced in pursuing insurance claims Estate Planning:Dan serves as council for several individuals who have required complicated estate planning, including wills, trusts, homestead exemptions, powers of attorney, medical directives, and charitable organizations. Financial Institutions:The firm currently represents several financial institutions and Dan's experience in banking, transactions, collections and workouts has been most valuable in dealing with the issues and needs of these particular clients. Dan has recently been involved in revising the loan related documents of a financial institution to provide better protection to lenders and to clarify and expedite the remedies available to the lender. Associations:Dan is a member of the American Bar Association, the American Trial Lawyers Association, the Utah Bar Association and the California Bar Association. He is a former Affiliate member of the Board of Realtors and member of the Association of General Contractors. Honors and Education:Legal Utah Business Magazine has recognized Dan as a member of Utah Elite for 2006, 2007 & 2008. Likewise, Super Lawyers Magazine named Mr. Anderson as one of the communities' best in 2007 & 2008. Dan graduated second in his class, Cum Laude, from Western State University in 1978 where he was a moot court competitor and was a member of the law review editorial board.
